The Conclave witnessed participation from leading intellectual property professionals, academicians, industry experts, students, and young practitioners from across the country. The theme of this year’s conclave focused on the evolving interface between Intellectual Property Rights (IPR), Artificial Intelligence (AI), and global regulatory governance.
One of the major highlights of the seminar was the Third Technical Session, which featured a live Mock Trial designed to provide practical courtroom exposure to students and junior lawyers. The Mock Trial revolved around complex legal issues relating to infringement of designandpassing off in trade dress/shape of goods.
Advocate Avadhoot Sumant appeared for the Plaintiff and presented detailed arguments on the scope of protection under design law and the distinctiveness of trade dress. Representing the Defendant, Mr. Shahvata Shukla advanced comprehensive counter-arguments, challenging the claims of infringement and addressing issues concerning functionality and originality in design protection. Both advocates argued at length, simulating real courtroom advocacy and legal strategy.
After hearing the submissions of both sides, Hon’ble Justice Mr. A.C. Rao (Former Judge of the Gujarat High Court) delivered his expert opinion and valuable judicial insights on the issues involved. His observations provided clarity on contemporary challenges in design infringement and trade dress litigation, especially in the context of emerging technologies and market competition.
The Mock Trial proved to be highly educational and engaging, offering students and junior lawyers a rare opportunity to witness practical litigation strategy, procedural aspects, and judicial reasoning in an academic setting.
MarkPatent expressed its commitment to continue organizing such annual conclaves to promote awareness and deeper understanding of Intellectual Property Rights, Artificial Intelligence, and Global Governance. The organizers emphasized that such initiatives play a crucial role in nurturing young legal minds and strengthening professional competence in the rapidly evolving IP landscape.
